Mediation Online: A Growing Trend

Alvin M. Hattal, writing in MyBusiness Magazine, says a new trend for small businesses is Internet mediation. He says it is “cheaper and faster than litigation, and usually leads to a settlement all parties find reasonable.” Using online mediation, it’s now possible to settle a dispute without having to meet with your adversary again.

One company offering online mediation, ClickNSettle.com, charges each party $100 each if the case settles for less than $10,000; $200 if more than $10,000. A typical timeframe for settlement is about two months. The trend is definitely growing: Another online mediation service, cybersettle.com, has seen a 32% increase in business over the last year.

The American Arbitration Association has developed guidelines for online resolutions, including that each business starts negotiations with a clear understanding and agreement of terms and conditions for the mediation. Hattal says “As the trend grows, small businesses can increasingly avoid the need for costly, time-consuming litigation and truly achieve more win-win results.”
